Greenhouse brawl: Man escapes jail

A MAN who left a police officer needing hospital treatment after wrestling him through a greenhouse and showering him in glass has escaped jail.

Hassan Niyazi, 25, pleaded guilty to assaulting a police officer, at a hearing at Wigan Magistrates’ Court.

The court was told how Niyazi, who had already been convicted of theft at an earlier hearing, had wrestled with officers who came to arrest him after a dispute over a missing laptop.

He was found guilty of theft at an earlier hearing at Wigan Magistrates’ Court on February 6.

Prosecuting, Mr Wood said: “He (Niyazi) was in a short relationship with Laura Hensley and after a dispute she asked him to leave her home in Tyldesley.

“Upon returning home she found her laptop to be missing and called the police.

“He was traced to a relative’s address and upon being questioned by officers about the laptop he kicked off claiming he left it in the complainant’s bedroom.

“As he tried to make good his escape, he grappled with officers and they went through a greenhouse causing an officer to be cut by shards of glass.

“In a victim impact statement, the complainant Laura Hensley said the laptop had contained pictures of her daughter growing up which are now lost forever and that he stole it to spite her and she finds the theft disgusting.”

Defending Niyazi, Ged Fraser said: “This was not a case of deliberately trying to inflict injury upon a police officer.

“In fact my client came off worse and had to be taken to hospital.

“The police officer was inadvertently injured and it was unintentional and he was instantly remorseful.”

Niyazi was ordered to carry out 80 hours unpaid work, ordered to pay £280 in compensation, a £60 victim surcharge and was given a restraining order not to contact Laura Hensley for six months.
