A WIGAN man who pinned down the mother of his three children with his elbow has been hit with a restraining order.
Stuart Birch flew into a rage after Samantha Kemp refused to give him a cigarette.
Wigan Magistrates’ Court heard how he first grabbed the victim’s bank card and threatened not to give it her back before snatching her mobile phone and saying he would keep hold of it until she gave him a cigarette.
Katie Beattie, prosecuting, told how Birch, 32, then hurled the phone at Ms Kemp, grabbed hold of her and threw her onto a sofa.
He then pinned her down, holding his arm across her throat, and only released his grip when one of her children ran in and shouted “don’t hit my mum”.
The victim’s sister, Joanne, then called police after Ms Kemp told her what had happened.
Birch, who was not represented by a solicitor, told the court he had been trying to calm Ms Kemp down but admitted catching her with his arm.
Magistrates handed Birch, of Westgate Drive, Orrell, a six-month community order and a 12-month restraining order.
They also ordered him to pay a £100 fine, £100 compensation to Ms Kemp, £85 costs and a £60 victim surcharge.
