Man in court after pushing woman to the floor

David John Miller, 42, pleaded guilty to assaulting Angela Whalley when he appeared at Wigan and Leigh Magistrates’ Court yesterday.

He had previously denied the charge and the case was fixed for trial, but he decided to change his plea.

However, he will have to wait until Monday to be sentenced as the hearing was adjourned so a report could be prepared for the magistrates.

The court heard the incident happened just before 9pm on Monday, July 9.

Katie Beattie, prosecuting, said Miller was looking for his former partner as he wanted to talk to her about having access to their child.

Her mother went to find him to talk to him about it.

Ms Beattie said: “It’s accepted he had a confrontation with Mrs Whalley. He will say, ‘she came towards me, leaving me scared, therefore I pushed her and as a result she fell to the floor’. She banged her head and that caused an injury.”

She said a bump formed on Mrs Whalley’s head and she went to hospital for treatment, but the injury did not cause any long-term problems.

Defending, Nick Woosey said Miller, of Bright Street, Westleigh, had mental health issues and suggested the case be adjourned for a week so a pre-sentence report could be prepared.

John Mason, chairman of the bench, told Miller: “We will adjourn the case so the probation service can speak to you and prepare a report for us before we decide what the sentence should be.”

Miller must return to Wigan and Leigh Courthouse on Monday morning to be sentenced.

He was remanded on bail until that hearing, with conditions not to go to Hawthorn Rise in Whelley and not to contact Angela Whalley and Rebecca Whalley.

He was warned he could be remanded in custody if he breaches bail.
