Man jailed after smashing window of Wigan pie shop and delivery van

The court heard the 20-year-old plead guilty to the incidents of criminal damage which occurred in Platt Bridge in the small hours of July 29.

The court was also told that at the time of the incident Hughes was on a suspended sentence imposed for a very similar incident in which he had smashed the window of a McDonald’s eatery.

Ultimately this landed him in prison as the magistrates decided to activate the sentence which had been left hanging over his head on his previous court appearance.

Prosecuting, James Gore told the court the delivery driver pulled up at the pie shop at around 4am on July 29 and noticed the front window had been smashed and two men were hanging around.

He completed his delivery but when he returned to his vehicle found a side window of that had been wrecked as well.

Nick Lloyd, defending, said his client was intoxicated and was able to remember very little of what had happened.

However, he told the court it appeared Hughes had made admissions to the police officers who attended the scene,

Mr Lloyd said: “His recollection of the events leading up to these particular offences is somewhat limited and scant.

“Unfortunately he was in drink. He is under no illusions as to the jeopardy he has placed himself in.”

Mr Lloyd said Hughes had come under the sway of negative influences in his peer group at the time the criminal damage was committed, but had since moved to Liverpool to keep out of trouble.

However, a spokesperson for the probation service said it had been hard to stay in contact with him and he had only partially complied with the community order since it had been imposed along with the suspended sentence.

The magistrates activated the suspended sentence and jailed Hughes for eight weeks, and ordered him to pay £250 in compensation to Galloways.
