A MAN who molested a woman while she slept alongside her husband has been sent to prison.

A court heard that Kevin Birch had gone to the couple’s home after they they had been out drinking.

You had got into their bed uninvited and you have acknowledged throughout the trial it was wrong to do so

Judge Andrew Hatton

Birch, 59, quickly fell asleep but then on waking went upstairs and climbed into bed with his sleeping hosts.

The woman, who cannot be identified for legal reasons, awoke to find him seriously sexually assaulting her and she threw him out of bed and told her husband.

Birch, of Alma Walk, Up Holland, admitted he had been wrong to get into their bed but denied the offence of sexual assault last November.

However, a jury at Liverpool Crown Court convicted him after just over an hour’s deliberations.

Jailing him for six years, Judge Andrew Hatton told him that Birch knew the reality was that he did not have consent to sexually abuse the woman.

“You had got into their bed uninvited and you have acknowledged throughout the trial it was wrong to do so.”

He said that the woman was vulnerable because she was asleep in her own bed at the time of the offence.

He ordered Birch to sign on the Sex Offenders Register for life.

Paul Wood, defending, said that Birch has no previous convictions and is a hard working hgv driver.
