Long delay to retrial in death crash case

The retrial of a motorcyclist accused of killing a pensioner in Leigh town centre may not take place for another 11 months, a court has heard.

David Hurst, 52, of Diamond Street in Leigh, faced a Bolton Crown Court jury in February for causing Ghulam Rasul’s death by careless driving but it couldn’t reach even a majority verdict acceptable to the judge.

The trial was told 74-year-old pedestrian Mr Rasul was badly injured when in collision with a motorbike at Market Place’s junction with Lord Street on September 10 2018 and died two days later in hospital.

A hearing was later held at which prosecutors said they wished to press the charge again and a retrial date for September 14 was set.

But since then a huge backlog of cases has built up due to Covid-19 and August 23 2021 has now been set for a new trial.

However, it was stated that attempts would be made to bring the date forward in the interests of all parties.
