Man shoved his pregnant partner in drunken attack

Stephen McCabe, 27, was slapped with a restraining order after pleading guilty to assaulting Chantelle Gormally by beating her and criminal damage.

Wigan and Leigh Magistrates heard how McCabe, of Albert Street, Wigan, had been drinking when he got into an argument with his partner at her home on January 9.

He wanted to leave but she blocked his way and he began shoving her out of the way and into a wall.

He left the property but immediately tried to go back into retrieve his bike from the hallway.

Miss Gormally refused to let him back in but he began kicking the door in.

Steve Woodman, prosecuting, said: “He grabbed his bike and in doing so hit Miss Gormally on the knee with the pedal causing bruising.

“In a victim impact statement, she said ‘this incident has left me extremely scared of Stephen. I won’t put up with his abuse. I am scared of him and what he might do in the future’.”

The court also heard that a child was asleep in the house during the incident and was woken up by the noise but did not witness what happened.

Karen Schofield. defending, said: “Both McCabe and Miss Gormally had been drinking when the argument broke out.

“He wasn’t saying very nice things and is screaming at her to move.

“He shoves her back into a wall and he then leaves the address.

“It isn’t anything more than shoving, he doesn’t punch her or kick her.

“That should have been the end of it but it wasn’t.

“Mr McCabe wanted to get back inside for his pedal cycle.

“He is drunk, he isn’t thinking properly. If he had he would have left the address.

“He kicks the door down and goes into the hallway, grabs the bike and there isn’t any further deliberate assault.

“In the hallway is him, the bike and her and he didn’t realise at the time that he had caught her with the pedal.”

As well as the restraining order, McCabe was given a 12-month community order including a 10-day activity requirement and 50 days unpaid work.

He was ordered to pay £128 compensation for the damage to the door, £30 for damage done to a mirror, £100 compensation to Miss Gormally for the injuries he cause her, a £60 victim surcharge and £85 prosecution costs.
