Taunt leads new dad to punch his partner

A new mum was treated in hospital for a cut eye and lip after her partner punched her when she drunkenly claimed their 10-week-old daughter was not his.

Baker Evan Phillips, 30, of Cambridge Road, Bamber Bridge, near Preston, admits a charge of actual bodily harm on the basis that his partner had kicked him in the face as he pinned her down during an argument on September 13.

Sentencing him to eight months suspended for a year, Judge Leeming QC said: ”In the course of the argument in the early hours she taunted you by telling you – though it is accepted this is not true – the baby was not your daughter. That was clearly provocative but you reacted in a totally unacceptable and criminal matter. I have seen the photographs, this is a serious offence.”

Prosecuting, Paul Cummings said: “The complainant in her own statement has said it was all a bit of a blur. She tells the police officers she’d had 10 pints of lager and two Jaegerbombs.

“Later she made a statement and described this was the first time they had been out together since birth 10 weeks ago, and they had a lot of drink.

“Then she said she eventually decided she wanted to go to bed. He was not happy about that and wanted the evening to continue and then there was a falling out.

The court heard he had a previous domestic assaults on his record against the victim and another partner.

Defending, Nick Kennedy, said: “It is plain the aggravating feature is the fact he has been convicted of a similar offence.

He said the birth had motivated Phillips to get a job.

He must pay £150 costs, a £180 court charge and a £100 surcharge.
